Article 1 — Identification & Scope of Application

These Terms of Service ('Terms') govern the access to and use of the CraftyBot software application (available at craftybotai.com and related domains), operated by Keepsake3d, registered at Lavendelstraat 21, 9120 Beveren-Kruibeke-Zwijndrecht, Belgium, KBO/VAT BE1032478391 ('Keepsake3d', 'we', 'us', or 'our').

By registering an account, purchasing a subscription, or accessing CraftyBot, you ('User', 'Customer') enter into a legally binding agreement with Keepsake3d and agree to comply fully with these Terms.

Article 2 — User Account & Security

Access to CraftyBot features requires registration of an authenticated account. You agree to provide accurate, current, and complete registration information.

You are solely responsible for maintaining the confidentiality of your login credentials and for all activities occurring under your account. You must notify Keepsake3d immediately upon suspecting any unauthorized access.

Article 3 — Subscriptions, Tokens & Stripe Payment Terms

CraftyBot offers both recurring subscription plans (Apprentice, Master) and non-expiring AI Query Top-Up Boost Packs. Pricing is displayed in EUR (€) and processed securely through Stripe Payments.

Recurring subscriptions automatically renew at the end of each billing cycle (monthly or annually) unless canceled prior to the renewal date via the Customer Billing Portal.

Top-Up AI query boosts do not expire and roll over indefinitely until consumed.

Article 4 — Value Added Tax & Art. 56bis WBTW Exemption

Keepsake3d is a small enterprise subject to the tax exemption scheme under Article 56bis of the Belgian VAT Code (WBTW).

All fees and invoices are issued without VAT ('Kleine onderneming onderworpen aan de vrijstellingsregeling van belasting. Btw niet toepasbaar - art. 56bis WBTW'). Customers are not charged Belgian VAT.

Article 5 — EU Consumer Right of Withdrawal & Digital Waiver

Under European Directive 2011/83/EU and Belgian Code of Economic Law (WER Book VI), consumers (B2C) generally possess a statutory 14-day right of withdrawal for distance sales.

Immediate Digital Execution Waiver: For digital subscriptions and query packs, you expressly request and consent that the digital service begins immediately upon successful checkout. You explicitly acknowledge and agree that you lose your statutory 14-day right of withdrawal once the digital service delivery has begun.

If you are a consumer and have not accessed or used the paid digital service, you may exercise your withdrawal right within 14 days by submitting our Model Withdrawal Form to [email protected].

Article 6 — Technical Tools, AI Assistant & Craftsman Disclaimer

CraftyBot provides specialized trade calculators (cut list optimization, electrical wire sizing, plumbing discharge calculations, welding parameters, masonry estimators) and AI assistant suggestions.

Advisory & Decision-Support Only: All calculations, cut diagrams, compliance citations (AREI, NEN 1010, NF C 15-100, NEC), and AI generated recommendations are provided as automated drafting aids and preliminary estimation tools. They DO NOT constitute formal engineering certifications, certified electrical inspection approvals, or structural warranties.

Craftsman Responsibility: The user/craftsman remains solely and independently responsible for verifying all dimensions, material specifications, load tolerances, electrical safety clearances, and local statutory building codes before executing physical fabrication or on-site installation.

Article 7 — Limitation of Liability

To the maximum extent permitted by applicable Belgian law, Keepsake3d shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, material waste, workshop downtime, or installation defects resulting from reliance on calculation outputs or AI suggestions.

Our aggregate liability for direct damages arising out of or related to your use of CraftyBot shall in all circumstances be strictly limited to the total fees paid by you to Keepsake3d in the twelve (12) months preceding the incident.

Article 8 — Intellectual Property & User Data

All rights, titles, and interests in and to CraftyBot (including source code, algorithms, visual interface, and branding) remain the exclusive intellectual property of Keepsake3d / Tom Van Geert.

You retain full ownership over your workshop inventory data, project records, client quotations, and custom material lists uploaded to the service.

Article 9 — Account Termination & Suspension

You may terminate your account at any time via your account settings. Keepsake3d reserves the right to suspend or terminate accounts that violate acceptable use policies, engage in abusive scraper operations, or attempt reverse engineering.

Article 10 — Governing Law & Dispute Resolution

These Terms and any dispute arising from them shall be governed exclusively by the laws of Belgium, without giving effect to conflict of laws principles.

The courts of the judicial district of Dendermonde (Oost-Vlaanderen), Belgium have exclusive jurisdiction over any disputes. Consumers residing in the EU may additionally access the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr.
